Terms and Conditions
Styling You (“we” “us”) website(s) (our “Site” or “Sites”) and related services are made available to you in accordance with the following Terms and Conditions and any other rules posted on our Sites (collectively, the “Terms”). Please read the Terms carefully before placing any orders on stylingyoushop.com.au. We recommend you should keep a copy of the Terms for future reference. - ELIGIBILITY TO PURCHASE
All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers. Styling You offers products for sale that are in stock and available for dispatch from our distribution centre. Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it. Orders cannot be cancelled the contract between you and Styling You is completed when the order is made. The sale contract is therefore concluded in Brisbane, Australia and the language of the contract is English. We reserve the right not to accept your order in the event, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the Terms. We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun. Once orders are made, they cannot be cancelled or edited. Styling You will store a record of your transactions for a minimum of one year.
- PRICING POLICY
Prices shown on the Site are in Australian Dollars (AUD) and are inclusive of GST at the applicable rate. All prices and offers remain valid as advertised from time to time. The AUD price of a product displayed on the Site at the time the order is accepted will be honoured, except in cases of patent error. Product prices are set at the beginning of each season using existing currency exchange rates.
Payment can be made by Visa, MasterCard, American Express, PayPal, Afterpay and any other methods which may be clearly advertised on the site from time to time. Payment will be debited and cleared from your account upon dispatch of your order by Styling You. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Styling You, we will not be liable for any delay or non-delivery. We take reasonable care to make our Site secure. All credit/debit card transactions on this site are processed using PayPal, Shopify Payments, Afterpay and secure online payment services. If you are a registered Styling You user, we will securely store your credit/debit card details on our systems. These details will be fully encrypted and only used to process card transactions, which you have initiated. To help ensure that your shopping experience is safe, simple, and secure, Styling You uses Secure Socket Layer (SSL) technology. Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.
- DELIVERY, SHIPPING AGENTS & SHIPPING COSTS
AUSTRALIAN SHIPPING COST
$15 (including GST) flat rate Express Post shipping. For orders more than $250, express post shipping is free of charge.
All Australian Orders are dispatched using Express Post - via Australia Post - unless otherwise indicated.
INTERNATIONAL SHIPPING COST
Shipping to New Zealand is $20 AUD, free for orders over $350.
We also have shipping set up for the following countries with a flat rate of $30AUD:

Please email email@example.com for a quote for your country if it's not one of these. Please be aware that you are liable for any duties, customs and taxes levied by the country your order is being shipped to. Styling You The Label cannot advise you what these costs may be.
6.3 SHIPPING TERMS
Unless otherwise noted, all orders will be dispatched from our Brisbane warehouse the same business day if ordered before 12noon AEST time. During peak times, it may take longer for us to dispatch your order.
Delivery times are to be used as a guide only and commence from the date of dispatch. Styling You will use best efforts to meet the indicated delivery times. If delivery is attempted and nobody is available to accept the parcel, in most cases it should be held at your local post office. If you are not contactable and your parcel is unable to be delivered, it will be returned to Styling You and we will attempt to contact you to arrange alternate delivery.
- LOSS OF GOODS
The risk of loss of goods shall be passed to you upon delivery of your product to Styling You’s nominated shipping agent. For all deliveries you authorise for the goods to be left at your specified address and your order will have been deemed delivered as if it had been signed for. Styling You will not be held responsible for any loss, damage or liability as a result of this authority.
- RETURNS POLICY
8.1 STYLING YOU
- 14-day Returns policy for Australian orders. Returns must be lodged through our Returns Portal and sent to our warehouse. DO NOT send items to the PO Box listed on the Order Confirmation email. This will only delay processing of your return.
- Only non-discounted items are eligible for a return. No returns on sale or promotional discounted items.
- FREE return shipping and handling if returning for credit/gift card.
- $15 flat rate return shipping and handling rate for refund requests - a postage label will be supplied to you. We ask that you use this label to ensure your return is tracked.

- Returns from different orders need to be returned separately. Separate $15 fees will apply for returns from each order if requesting a refund.
- Basics Bundles returns: any returns will account for changes in the number of remaining items in your order. Your original discount will be forfeited if returning more than the qualifying amount of items. When you lodge your return for an order with Basics Bundles and full price pieces, the refund amount may be different. These returns are automatically flagged in our system and will be amended when processed.
ONLINE ORDERS: Styling You (www.stylingyoushop.com.au) will accept any returns and exchanges that are requested and returned to us within 14 days of the date of your order. Requests for and receipt of returns (refunds, exchanges or store credit) after 14 days from the date of your order being shipped will not be considered. Items marked as reduced as part of a store-wide promotion or clearance sale on the shop site cannot be returned. This applies to all sale items, including those sold in short-term promotions. The item(s) must not be worn, altered or washed and be accompanied by all original tags in original packaging. There must not be any pet hairs, makeup stains or perfume odours on the item/s. If a returned item is found to have odours or stains on it, we will only refund less a dry-cleaning fee of $30 per item. If the item is completely unsellable we will not refund at all.
Once a Return has been received, assessed and approved by the Styling You The Label warehouse team, the balance of the goods will be refunded to your original method of payment within 5 business days of receipt.
IN STORE: If buying at a warehouse sale or pop-up, a refund is only available on faulty items.
8.2 RETURN APPROVAL
All returns must be submitted via our online portal HERE.
DO NOT send returns to our PO Box. Doing so will cause a delay in processing of your return as the warehouse is some distance from the PO Box and the PO Box is only checked once a week.
The Returns Portal will not accept or process a return for an item/s that has/have been discounted in a sale or promotional period. It will also not process international returns and returns outside of our 14-day returns period.

We want you to be completely satisfied with your online purchase. If you change your mind for any reason, we'll gladly accept a return of any full priced item subject to the following conditions:
- the item/s must be returned within 14 days of ordering We suggest all items are tried on as soon as they are received to ensure you are able to return items within this timeframe. If your returns request is outside our 14-day window, please check out our Buy Swap and Sell Facebook page where you can sell your item/s.
- item/s must be returned in original condition, unworn, unaltered, unwashed and with their tags attached. If a returned item is found to have odours or stains on it, we will only refund less a dry-cleaning fee of $30 per item. If the item is completely unsellable we will not refund at all.
- if you have received a gift with purchase during a promotion, the gift must also be returned otherwise the value of the gift will be deducted from your refund.
Please note, should we identify unreasonable patterns of returns or purchase, or use of garments for the creation of content for personal or professional gains, we may restrict or refuse future orders.
When we receive the returned item from you, we will inspect the garment and process a refund if it meets our assessment conditions mentioned above.
8.3 RETURN SHIPPING FEES
Shipping fees on refund requests are not refundable.
For Australian orders, returns are free if you choose to return for store credit/gift card. You'll be supplied with an Australia Post label to affix to your parcel (retain your original packaging to re-use).
If you would prefer to return for a refund, we retain $15 from your refund to cover handling and the Australia Post shipping label generated for you. This option ensures your package is trackable and we are able to cover your return should it be lost in transit. PayPal users, this will not show up as a shipping fee on your refund so is not eligible for PayPal free returns.
For International returns, you will be responsible for shipping and handling charges to return any unwanted items. If the package does not reach us safely we will not be able to complete the refund, we recommend sending via a traceable method for peace of mind and to retain proof of postage until you have received confirmation that your return has been processed. Please email email@example.com for the return shipping address.
In case of a parcel being rejected at customs due to change of mind, we reserve the right to withhold duties and taxes incurred from your refund once it has been returned to us. Please note, these are treated as return to sender parcels which are considered low priority by the courier and can take up to three (3) months to arrive back at our warehouse.
Please note: Subject to our obligations under the Australian Consumer Law or similar legislation, international returns cannot be accepted where the value of the items being returned in one shipment is over $1000. Please ship the items separately as we are not responsible to pay duties to receive the goods. If there is a charge it may be deducted from your final refund.
8.4 RETURN ADDRESS
Do not send a return without first requesting approval for the return through our online returns portal HERE. Sending returns to our PO Box address will delay the processing of your return as the warehouse which processes our returns is some distance from the PO Box and the PO Box is only checked once a week.
If wishing to return items from an International order, please email firstname.lastname@example.org for a return address.
Size exchanges can be made through the Returns Portal. If the desired size is in stock it will show as available for exchange.
$15 flat rate return shipping and handling fee will be charged for exchange requests. You'll be requested to pay this before an exchange can be submitted. Once paid, a postage label will be supplied to you. We ask that you use this label to ensure your return is tracked.
Once the item for exchange is received and processed at our warehouse, an order in our online store will be made for the new size and sent out to you via Express Post. There is no charge to have this item posted to you.
8.5 FAULTY/INCORRECT ITEMS
We're very sorry if an item you received is not in perfect condition, or one that you didn't order! Please email email@example.com and we can resolve this for you as soon as possible.
We will meet our obligations under the Australian Consumer Law or similar legislation which may include replacing the item if the stock is available or providing a refund upon receipt of the item back at our warehouse.
9. STYLING YOU GIFT CARDS
These Terms and Conditions govern the use and operation of your Styling You Gift Card, sold and only redeemable at www.stylingyoushop.com.au
Styling You Gift Cards cannot be sold without the prior written consent of Styling You. Styling You must approve in writing any material which includes reference to ‘Styling You’ or ‘Styling You Gift Cards’.
9.1. AGREEING TO THE GIFT CARD TERMS AND CONDITIONS
9.1.1 You agree to be bound by these Terms and Conditions by purchasing, activating, using or attempting to use your Styling You Gift Card or making any transactional query.
9.1.2 By using a Styling You Gift Card, you warrant to us that you will comply with these Terms and Conditions and all applicable laws and that your Styling You Gift Card will not be used in any manner which is unlawful, misleading, deceptive or unfair.
9.1.3 If you are giving a Styling You Gift Card to another person, you must ensure that the recipient of the Styling You Gift Card is aware of the Terms and Conditions that apply to the Styling You Gift Card and the relevant expiry date.
9.1.4 Styling You Pty Ltd reserves the right to amend all or part of these Terms and Conditions at any time.
9.2 PURCHASING A STYLING YOU GIFT CARD
9.2.1 Styling You Gift Cards can only be purchased online at www.stylingyoushop.com.au
9.2.2 Once purchased, a Styling You Gift Card will be issued in PDF form and emailed to the nominated recipient’s address.
9.2.3 Styling You Gift Card currency is Australian Dollars (AUD).
9.2.4 Styling You Gift Cards can be purchased in a variety of values as listed at www.stylingyoushop.com.au
9.2.5 The minimum and maximum value which can be loaded on to each Styling You Gift Card may change from time to time.
9.2.6 Once a Styling You Gift Card has been purchased, it cannot be refunded.
9.2.7 Styling You is not liable for any Styling You Gift Cards purchased through any online auction sites.
9.3 REDEEMING A STYLING YOU GIFT CARD
9.3.1 Styling You Gift Cards can only be redeemed at www.stylingyoushop.com.au Any value redeemed will be deducted from the available balance.
9.3.2 If your purchase/s exceed the available balance on your Styling You Gift Card, you must pay the excess using another method of payment.
9.3.3 Styling You Gift Cards are valid for 12 months from the date of purchase. Our record of your expiry date is final. Once your Styling You Gift Card has expired the Styling You Gift Card cannot be re-activated and any unspent value cannot be used or redeemed by you.
9.3.4 Once a Styling You Gift Card has been purchased with a chosen value or when the Styling You Gift Card has reached a $0 balance, no further value can be added to it.
9.3.5 Styling You Gift Cards cannot be redeemed for cash. No cash advances will be made at any time.
9.3.6 You do not need to use the entire available balance in one transaction. No change will be given, however, the remaining available balance may be applied to future purchases until the Styling You Gift Card expires or the balance reaches $0.
9.4 TRANSACTION INFORMATION
9.4.1 You can check the available balance of your Styling You Gift Card by visiting the checkout at www.stylingyoushop.com.au
9.4.2 To find out information on your Styling You Gift Card using the link above, you will be required to enter your Styling You Gift Card code.
9.4.3 Your Styling You Gift Card code is located on the PDF you received via email.
9.5 LOST OR STOLEN STYLING YOU GIFT CARDS
9.5.1 You should treat your Styling You Gift Card like cash.
9.5.2 Styling You Gift Cards cannot be replaced or refunded if lost, stolen or damaged.
9.5.3 We reserve the right to place a stop on your Styling You Gift Card if:
(a) you report that your Styling You Gift Card has been lost, stolen or damaged; or
(b) we believe (or reasonably suspect) that you have used (or will use) your Styling You Gift Card contrary to these Terms and Conditions.
9.5.4 At our absolute discretion, we may change our policies and procedures on lost, stolen or damaged Styling You Gift Cards. If we decide to do this, we will publish details on our website.
9.6 ERRORS AND COMPLAINTS
9.6.1 If you wish to dispute an amount deducted from your Styling You Gift Card, you must contact us via email at firstname.lastname@example.org If an amount is not disputed within ninety (90) days after the transaction date, we may (at our sole discretion) refuse to provide you with a refund.

This contract will be governed by the laws of Queensland, Australia. Any dispute arising out of your use of the website, www.stylingyou.com.au or www.stylingyoushop.com.au, or the products purchased on them, will be subject to the exclusive courts of that jurisdiction.
- INTELLECTUAL PROPERTY RIGHTS
Your use of the Sites and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to the Content (as described in the Content section below), including Styling You Software and all HTML and other code contained in this Site. All such Content including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Site are protected by national intellectual property and other laws and international treaty provisions. You are permitted to use the Content only as expressly authorised by Styling You and/or its third party licensors. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties. Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is expressly prohibited. However, you are permitted to make one copy for the purposes of viewing Content for your own personal use.
In addition to the Intellectual property rights mentioned above, “Content” is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this Site. Styling You tries to ensure that the information on this site is accurate and complete. Styling You does not promise that Styling You Content is accurate or error-free. Styling You does not promise that the functional aspects of the Site or Styling You Content will be error free or that this Site, Styling You Content or the server that makes it available are free of viruses or other harmful components. We always recommend that all users of the Internet ensure they have up to date virus checking software installed. This Site is for your personal non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any Content, software, products, or services contained within this Site. - YOUR RIGHTS
You have certain rights under the law. In Australia these include:
- That any products you order through this Site will be of satisfactory quality, fit for their intended purpose, and will conform to any description given on this Site;
- Certain remedies if a product is defective; and
- A right to cancel any order for a product within seven working days commencing on the day after the date on which you receive it, and receive a full refund even if it is not defective.

- LIMITS ON OUR LIABILITY
We accept liability for death and personal injury arising from our negligence or that of our employees and agents. We do not seek to exclude our liability for fraudulent misrepresentation by us or our employees or agents. Nothing in the Terms is intended to affect your rights under the law (see “Your Rights” above). If Styling You breaches the Terms we shall only be liable for losses which are direct losses and a reasonably foreseeable consequence of such a breach. Losses are foreseeable where, for example, they could be contemplated by you and Styling You at the time of you placing your order, and Styling You dispatching your order. We shall only be liable for losses up to 150% of the total value of goods purchased. We are not responsible for losses not caused by our breach or negligence, indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us (for example, loss of profits or loss of opportunity). We are also not responsible for failure to meet any of our obligations under the Terms where such failure is due to events beyond our reasonable control.
At our request, you agree to compensate us fully, defend us, and hold us, Styling You harmless immediately on demand, its officers, directors, agents, affiliates, licensors, and suppliers, from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the Terms by you, including the use by any other persons accessing this Site using your Internet account caused by your action or inaction.
- OUR RELATIONSHIP
You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and Styling You as a result of the Terms or your use of this Site. You agree that you may not and will not hold yourself out as a representative, agent, or employee of Styling You, and we shall not be liable for any representation, act, or omission on your part.
- NO WAIVER
If you breach the Terms and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach the Terms.
- GOVERNING LAW
The Terms together with all our policies and procedures will be governed by and construed in accordance to the relevant Australian law and the relevant courts of Australia will have exclusive jurisdiction.
22.1 WHAT DO WE DO WITH YOUR INFORMATION?
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your permission, we (and third party suppliers) may send you emails about our store, new products and other updates.
How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.
If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.
How do I withdraw my consent?

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

22.5 - THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.
Our store uses Google Analytics to help us learn about who visits our site and what pages are being looked at
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.
